« Martens Clause» Fortress Of Protection In Integrated Customary International Humanitarian Law

Abstract

The Martens Clause is a main principle, that aim to ensure the protection of people affected by armed conflict, even in situations not expressly covered by international treaties. This clause states that Respect for the values of humanity, public international conscience, and customary IHL is required of all parties participating in the war. The Martens Clause is a main tool for the protection of civilians and combatants in armed conflict. Despite the challenges facing its application, It continues to be the pillar of IHL and supports the advancement of human dignity in all circumstances.
