تعزيز المساءلة الجنائية الدولية في اٍطار مكتب المدعي العام على ضوء تجارب المحكمة الجنائية الدولية

الملخص
يعتبر مكتب المدعي العام من أهم أجهزة المحكمة الجنائية الدولية ، مكلّف بإجراء الفحوصات الأولية التحقيقات والملاحقات ، و يمتلك السلطة الكاملة في تنظيم وإدارة المكتب ، كما أنه مفوض لتلقي وتحليل الإحالات والاتصالات لتحديد ما إذا كان هناك أساس معقول لفتح التحقيق في الجرائم الأشد خطورة . وعليه تهدف هذه الدراسة الى إبراز دور مكتب المدعي العام في مجال تحقيق المساءلة الجنائية الدولية ،من خلال تسليط الضوء على المنهج الجديد الذي تبنّاه المكتب في التحقيق ، وإبراز أهميته في رسم أهداف إستراتيجية على أرض الواقع، تظهر فعاليتها عن طريق الممارسة الميدانية لعمله، وهذا ما يعزّز جانب المساءلة الدولية ويفعّل دور المحكمة في الحدّ من الإفلات من العقاب. Abstract The Office of the Prosecutor is considered one of the most important bodies of the International Criminal Court. It is charged with conducting preliminary examinations, investigations and prosecutions, and has full authority to organize and manage the office. It is also authorized to receive and analyze referrals and communications to determine whether there is a reasonable basis for opening investigations into the most serious crimes . This study aims to highlight the role of the Public Prosecutor’s Office in achieving international criminal accountability, By shedding light on the new approach adopted by the Office and clarifying its importance in setting strategic goals, the effectiveness of which is demonstrated through field practice, and this, is what strengthens the aspect of international accountability and activates the role of the Court in reducing From impunity.
