حياد قضاء الحكم الجنائي وضماناته

الملخص
يعدّ مبدأ حياد القضاء الجنائي من أهم المبادئ الإجرائية، وهو مكمل لمبدأ استقلالية القضاء، يكفل الوصول إلى تحقيق العدالة في نظر الخصوم والجماعة. ولا يمكن أن يكون القاضي الجنائي متمتعا بالحياد إلا بمراعاة جملة من الضمانات الوقائية والإجرائية، تتجلى الأولى في تجرد القاضي من الميول الذاتية وعدم قضائه بعلمه الشخصي، في حين أن الضمانات الإجرائية تكمن في عدم جواز الجمع بين وظائف القضاء الجنائي ومبدأ المساواة. The principle of impartiality of criminal justice is one of the most important procedural principles, and it complements the principle of judicial independence. It guarantees access to justice in the eyes of adversaries and the group. A criminal judge cannot be impartial unless he takes into account a set of preventive and procedural guarantees, the first of which is the judge’s freedom from personal inclinations, and his not judging with his personal knowledge, while the procedural guarantees lie in the inadmissibility of combining the functions of the criminal judiciary, and the principle of equality.
