Implementation Of Administrative Judgments Through The Coercive Fine

Authors : Dhib Mohammed . Otmani Ali .

Abstract

Abstract The coercive fine in the realm of administrative judgments is a compulsory measure aimed at implementing the judgment thereof. In the event of failure or refusal to implement the judgment, either in full or in part, the competent administrative court may impose a coercive fine for each day of delay in executing the judgment. If the refusal to execute persists, the judge will rule on the liquidation of the coercive fine as prescribed by law. Thus, the coercive fine in administrative judgments serves as an effective tool for the administrative judiciary to compel public administration that failed from executing the administrative judgment, to adhere to the decisions of the administrative judiciary issued in the name of the Algerian people.
