الملخص
نظرا لاِتسام العلاقات التجارية بالسرعة والائتمان، كان لابد من خلق بيئة قانونية تتماشي ومرونة هذه المعاملات، فبعد أن كانت المحاكم التجارية العادية تعنى بفض النزاعات التجارية بشتى أنواعها، ولعدم تعطيل المصالح الاقتصادية للمستثمرين نظرا لطول أمد الإجراءات، كان لزاما تعديل القوانين استجابة للتطور الحاصل. سعت الدولة الجزائرية إلى تدعيم حركية الاستثمار والتجارة، وتحقيقا للأمن القانوني والقضائي لدى المستثمرين المتقاضين والتجار، كان لابد من اِستحداث محاكم تجارية متخصصة لفض النزاعات المتعلقة بنشاطاتهم، لأنّ اِستقطاب الاستثمار وجلب التكنولوجية لن يتأتى في حالة غياب عدالة متخصصة وعدم وجود أمن قانوني وقضائي. Given that commercial relations are characterized by speed and credit, it was necessary to create a legal environment that aligns with the flexibility of these transactions. Initially, ordinary commercial courts were responsible for resolving various types of commercial disputes. However, to avoid disrupting the economic interests of investors due to lengthy procedures, it became imperative to amend laws in response to ongoing developments. The Algerian state has sought to strengthen the dynamics of investment and trade, and to achieve legal and judicial security for litigating investors and traders. This necessitated the establishment of specialized commercial courts to resolve disputes related to their activities. Attracting investment and technology cannot be achieved without specialized justice and the existence of legal and judicial security.
