Specialized Commercial Judiciary: The Specialized Commercial Court In Algeria As A Model

Abstract
Abstract: Specialized commercial courts represent an important mechanism for addressing the growing complexity of commercial transactions. Algeria has established such courts to handle commercial disputes more efficiently and improve the quality of judicial decisions. Their jurisdiction covers disputes related to commercial contracts, companies, and banking transactions. This specialization enhances judges’ expertise and contributes to the stability of commercial relations. It also strengthens investors’ confidence in the national judicial system. However, challenges remain, particularly regarding specialized training and procedural delays. Therefore, continuous development of this judicial model is essential to ensure greater effectiveness and support economic growth. الملخص: يُعدّ القضاء التجاري المتخصص آلية حديثة لمواكبة تعقيد المعاملات التجارية. وقد اعتمدت الجزائر هذا النظام من خلال إنشاء محاكم تجارية متخصصة تختص بالفصل في المنازعات التجارية. ويهدف هذا التوجه إلى تسريع الفصل في القضايا وتحسين جودة الأحكام القضائية. وتختص هذه المحاكم بالنظر في النزاعات المتعلقة بالعقود التجارية والشركات والمعاملات البنكية. ويسهم هذا التخصص في تعزيز خبرة القضاة وتحقيق استقرار المعاملات التجارية. كما يعزز ثقة المستثمرين في النظام القضائي الوطني. ومع ذلك، لا يزال النظام يواجه بعض التحديات، مثل نقص التكوين واستمرار بعض التأخيرات الإجرائية. ولذلك، يبقى تطوير هذا النموذج ضرورياً لتحقيق فعالية أكبر ومواكبة التطورات الاقتصادية.
