The Development Of Algerian Environmental Legislation In Comparison To International Environmental Legislation

Abstract
Abstract: Considering the international concern for the environment due to escalating environmental problems and issues in the second half of the twentieth century, it arrived belatedly, reflecting a negative image in the legal and operational treatment of those problems and issues. This is also evident in national legislations that are striving to keep up with current developments related to the environment and its protection. The same holds true for Algerian environmental legislation. Despite considerable efforts in the field of the environment and its protection through successive constitutions and environmental laws, it still requires much more effort compared to international environmental legislation. This is especially relevant given the evolution and modernization of the field, all of which are occurring amid the exacerbation of various environmental problems. ملخص: بالنظر إلى الاهتمام الدولي بشأن البيئة جرّاء المشكلات و القضايا البيئية المتفاقمة في النصف الثاني من القرن العشرين ، إلاّ أنّه جاء مُتأخرًا وهو ما يعكس الصورة السلبيّة في المُعالجة القانونيّة والعمليّة لتلك المشكلات والقضايا ، وهو أيضًا ما يعكس نفسه في التشريعات الوطنيّة التي تُحاول جاهدةَ مُواكبة التطورات الراهنة بخصوص كل ما يتعلق بالبيئة وحمايتها.وهو نفس الحال في التشريع البيئي الجزائري ، رغم أنّه حاول الكثير من الجُهود في مجال البيئة وحمايتها من خلال الدساتير المتعاقبة والقوانين الخاصة بالبيئة ، إلاّ أنّه بالمقارنة مع التشريع البيئي الدولي لا يزال يحتاج إلى الكثير من الجهود ، خاصة مع تطور وعصرنة المجال وكل ذلك في ظل تفاقم المشاكل البيئية المتعددة والمتنوعة .
