النظام القانوني لحق الموظف في العطلة لإنشاء مؤسسة من خلال القانون رقم 22-22 ونصّه التنظيمي

الملخص
تضمّن القانون رقم 22-22، تتميم الأمر 06-03 بثمانية مواد جديدة، بداية من المادة 206 مكرر الى م 206 مكرر 7، تضمنت استحداث حق وظيفي جديد للموظف يسمح له بإنشاء مؤسسة وفقا لشروط وضوابط قانونية معينة، وتفصيلا لشروط وكيفيات استفادة الموظفين من هذه العطلة وبيان الآثار المترتبة عنها، تم اصدار المرسوم التنفيذي رقم 23-93 المؤرخ في 5 مارس 2023، حيث يمكن للموظفين المنتمين لأسلاك معينة، والذين يحوزون أقدمية 5 سنوات ويقل سنهم عن 55 سنة تقديم طلب الاستفادة من العطلة الخاصة بإنشاء مؤسسة، هذا الأخير يخضع للدراسة من طرف الادارة، التي يمكنها الموافقة عليه أو تأجيل الموافقة عليه أو رفضه لضرورة المصلحة، وفي حالة قبول طلب الموظف تعلق الرابطة الوظيفية لمدة سنة قابلة للتمديد لستة أشهر، وللموظف الحق في اعادة الادماج في منصبه بناء على طلبه في حالة فشل مشروع المؤسسة، كما قد تنتهي الرابطة الوظيفية في حالة نجاح مشروع المؤسسة. In the event that the public officers request is accepted, the functional relationship is suspended for one year, extendable for an additional six months, The public officer has the right to reintegrate into their position upon his request incase the nonsuccess of the business project , and the functional relationship may terminate incase of the business project's success.
