Abstract
Abstract: This study examines the civilizational and legal significance of human security through a comparison between Islamic religious reference and positive legislations, seeking to build an integrative approach that achieves human dignity. The study reviews the legal foundations of security in Islam through the comprehensive objectives (maqasid) and the five necessities, and analyzes the evolution of the human security concept in international covenants and national legislations. The study highlights the importance of integration between the stability of values in Islamic law and the flexibility of mechanisms in positive legislations to address contemporary challenges such as armed conflicts, poverty, refugees, and environmental degradation. The study concludes by presenting practical mechanisms to achieve this integration at legislative, institutional, and applied levels, proposing the establishment of national observatories for human security, enhancing cooperation between religious and international institutions, and developing educational curricula that combine Islamic values with international charters. الملخص: تتناول هذه الدراسة المدلول الحضاري والقانوني للأمن الإنساني من خلال المقارنة بين المرجعية الدينية تتناول هذه الدراسة المدلول الحضاري والقانوني للأمن الإنساني من خلال المقارنة بين المرجعية الدينية الإسلامية والتشريعات الوضعية، ساعية إلى بناء مقاربة تكاملية تحقق الكرامة الإنسانية. تستعرض الدراسة الأسس الشرعية للأمن في الإسلام من خلال المقاصد الكلية والضروريات الخمس، كما تحلل تطور مفهوم الأمن الإنساني في المواثيق الدولية والتشريعات الوطنية. تبرز الدراسة أهمية التكامل بين ثبات القيم في الشريعة الإسلامية ومرونة الآليات في التشريعات الوضعية لمواجهة التحديات المعاصرة كالنزاعات المسلحة والفقر واللاجئين والتدهور البيئي. تخلص الدراسة إلى تقديم آليات عملية لتحقيق هذا التكامل على المستويات التشريعية والمؤسسية والتطبيقية، مع اقتراح إنشاء مراصد وطنية للأمن الإنساني وتعزيز التعاون بين المؤسسات الدينية والدولية، وتطوير مناهج تعليمية تجمع بين القيم الإسلامية والمواثيق الدولية.
