International Humanitarian Law In The Balance Of The Political Will Of The Great Powers: Between The Transcendence Of The Legal Rule And The Dominance Of Real Power

Abstract

Abstract : This paper examines the intricate relationship between International Humanitarian Law (IHL) and the political will of great powers, highlighting how the effectiveness of IHL largely depends on the states’ willingness to comply rather than on its intrinsic binding force. Despite the universal recognition of humanitarian norms, the selective application of IHL by major powers has undermined the credibility and universality of the legal system. Through an analytical and critical approach, the study reveals that IHL’s enforcement remains constrained by political interests and institutional asymmetries within the international system, notably the Security Council’s veto power and the politicization of humanitarian mechanisms. The paper argues that strengthening the independence of humanitarian institutions, reforming international accountability mechanisms, and embedding humanitarian values into national and diplomatic practices are essential steps toward restoring the balance between legal supremacy and political realities.
