Digital Surveillance And The Right To Privacy: An International Law Perspective

Authors : Triki Cherifa .

Abstract

The nature and extent of monitoring have been drastically altered by the rapid development of digital technologies, raising serious concerns about the protection of the right to privacy. Within the context of international law, this paper examines the theoretical foundations of digital surveillance, traces the evolution of the right to privacy, and evaluates key legal frameworks that safeguard it. The study assesses the effectiveness of these frameworks in addressing modern surveillance techniques and considers the impact of surveillance by public and private actors. It argues that, although privacy is recognized as a fundamental right, existing legal systems remain structurally inadequate to regulate contemporary digital surveillance. It concludes by emphasizing the need for a more nuanced, human rights–based approach that strengthens accountability and promotes international cooperation.
