Authors : Triki Cherifa .

Abstract

This study aims to analyze the legal framework of the crime of aggression under the Statute of the International Criminal Court, while clarifying the limits of the Court's jurisdiction and the reasons for its inability to prosecute those responsible for committing the crime of aggression in the Russian–Ukrainian conflict, particularly the restrictions related to jurisdiction over non-State Parties, our current study also discusses the political and legal ramifications of this inability and the resulting risk of perpetuating impunity and delegitimizing international deterrence, accordingly, an ad hoc international tribunal for the crime of aggression against Ukraine must be established as an alternative mechanism to fill the gap in the international judicial system and promote the principle of the rule of law globally.
