Abstract : This study investigates the judicial and administrative rescission of electronic administrative contracts within the context of digital transformation. It critically analyzes the administration’s prerogative of unilateral termination, exploring its legal constraints in an increasingly automated and digitized environment. The research further examines the administrative judge’s oversight of electronic rescission, distinguishing between penal rescission as a sanction and discretionary rescissionfor public interest. It assesses the judiciary’s authority to annul such decisions or award damages. The study concludes that maintaining a rigorous equilibrium between the administration’s discretionary powers and the legal safeguards of the digital contractor is fundamental to ensuring contractual justice in remote public procurement.
