الملخص

الملخص: تتناول هذه الدراسة إشكالات تنفيذ القرارات الإدارية القضائية في الجزائر، حيث يتقاطع القانون الإداري مع العدالة الإدارية. يهدف البحث إلى تحليل مدى فعالية آليات التنفيذ وضمانات حماية حقوق الأفراد، مع تسليط الضوء على التعقيدات التي تواجه الإدارة في تنفيذ الأحكام القضائية. تتناول الإشكالية كيفية ضمان الدولة لتنفيذ هذه الأحكام بفعالية، من خلال المنهج القانوني التحليلي. يتضح أن هناك تحديات متمثلة في عدم تنفيذ الإدارة للأحكام، مما يؤثر على هيبة القضاء وحقوق الأفراد، مما يستدعي البحث عن حلول قانونية وإدارية فعالة. Abstract:This study examines the problems surrounding the enforcement of administrative judicial decisions in Algeria, where administrative law intersects with administrative justice. The research aims to analyze the effectiveness of enforcement mechanisms and the guarantees for protecting individual rights, while highlighting the complexities faced by the administration in executing judicial rulings. The central issue lies in how the state can ensure the effective implementation of such decisions through a legal and analytical approach. The study reveals persistent challenges, notably the administration’s failure to comply with judicial decisions, which undermines both the authority of the judiciary and the rights of individuals. This situation calls for the development of effective legal and administrative solutions
