This study presents a critical evaluation of the modernist approach to Islamic legal texts and rulings, by analyzing selected cases in which scriptural injunctions are set aside under the pretext of applying the objectives of Sharia (Maqāṣid al-Sharīʿah). It demonstrates that modernist discourse often rests on a selective reading of Islamic sources, influenced by contemporary social, cultural, and ideological shifts. This approach tends to prioritize historical context and overarching objectives at the expense of established jurisprudential rulings. The study concludes that, while the consideration of maqāṣid is integral to Islamic legal reasoning, it must not entail the circumvention of definitive scriptural texts or the invalidation of their rulings—rulings that were revealed precisely to secure human welfare and uphold the public good.
