حقوق ضحايا الجرائم الدولية في ظل تطبيق مبدأ التكامل بين الضمانات والتحديات

الملخص
تهدف هذه الدراسة الى التطرق لموضوع حقوق ضحايا الجرائم الدولية في ظل تطبيق مبدا التكامل الذي يعتبر الحجر الاساسي الذي تبنى عليه تلك العلاقة التكاملية بين القضاء الوطني وكذا القضاء الجنائي الدولي الدائم في اطار تحقيق العدالة الجنائية الدولية القائمة على تبني فكرة الجزاء والردع من جهة وتكريس حقوق الضحايا من جهة اخرى هذا المفهوم الذي اصبح يحظى باهتمام بالغ حتى في ظل تطبيق مبدا التكامل فانه يلقى العديد من الدعائم والضمانات في سبيل تحقيق المبتغى الذي تسعى اليه اصول ومبادئ المحاكمات العادلة ومن ناحية اخرى قد يطرح بعض التحديات التي قد تكون عائقا امام الضحايا في استفائهم وحصولهم على حقوقهم. Abstract: -this study aims to adress the issue of the rights of victims of international crims in light of the application of the Principe of complementary which is considered the cornestone on which the complementary relationship between the national judiciary and the intrnational criminal court was built based on adopting the idea of deterrence and punishement on the one hand and enshrining the rights of victims on the other hand .This concept which has gained great attention even in light of the application of the principe of complementary .receives many guarantees and supports in order to achieve the goal sought by the principles of fair trials .on the other hand .this may pose some challenges that victims face in obtaining their rights.
