الفروق الفقهية عند الشيخ خليل من خلال كتابه"التوضيح"

الملخص
الملخّص تتناول هذه الدراسة جانبا من جوانب شخصية علَم من أعلْام المالكية، الشيخ خليل، من خلال شرحه الموسوم بـــ"التوضيح شرح مختصر ابن الحاجب"، وفيه نبذة عن سيرته الشخصية، وحياته العلمية المليئة بالتّدريس، والتأليف، والفتوى، وجهوده في خدمة المذهب المالكي، وخاصّة ما تعلّق بهذا الشرح؛ لما له من قيمة علمية في الفقه المالكي، حيث تميّز بالعناية بالخلاف المذهبي الواسع، وكذا الاستدلال على المسائل، وتعليل الأحكام، والاختيار والترجيح بين الأقوال، وبيان الفروق الفقهية. وهذا ما خصّصت له الحديث؛ لما للفروق من أهمية في التّمييز بين المسائل التي ظاهرها التوافق، وفي حقيقتها الخلاف؛ ممّا يحتاجه المفتي، والقاضي، والمدرّس للفقه الإسلامي، حتّى لا تضطرب بين يديه الأحكام فيحملها على التّوافق في حين هي مختلفة. وهذا هو الهدف من هذه الدراسة التي تعالج جانبا خفيّا ودقيقا من جوانب الفقه، يحتاج إلى العناية بالبيان والتّحليل. وقد توصّلت الدراسة إلى ثلّة من النتائج أهمها: ضرورة التّعرف على أعلام الفقه الإسلامي المغمورين، ومنهم أعلام المالكية، وعلى جهودهم في خدمة المذهب، من خلال مصنّفاتهم التي ما تزال في حاجة إلى التّحقيق والتّنقيح، ومن أبرزهم الشيخ خليل الذي عُرف بمختصره الشّهير، الذي اعتمده المتأخرون في العالم الإسلامي، ومنهم المغاربة. كذلك إبراز ما حوته تلك المؤلّفات من غرر ودرر وفوائد، كالجوانب المقاصدية، وتعليل الأحكام، والاختيارات الفقهية، والترجيحات. ومن أهمها الفروق الفقهية التي تناولته هذه الدراسة من خلال "التوضيح شرح على مختصر ابن الحاجب". الكلمات المفتاحية: الفروق- الفقهية- خليل- التوضيح- ابن الحاجب. Summary: This study explores an aspect of the personality of a notable figure among the Maliki scholars, Sheikh Khalil, through his commentary titled "Al-Tawdhih Sharh Mukhtasar Ibn Al-Hajib." The study provides a brief overview of his personal biography and his scholarly life, which was rich in teaching, authorship, and issuing religious verdicts. It highlights his efforts in serving the Maliki school, particularly through this commentary, which holds significant scholarly value in Maliki jurisprudence. The work is distinguished by its extensive attention to intra-school disagreements, reasoning for issues, justifications for rulings, preference between various opinions, and clarifying jurisprudential distinctions. The focus on jurisprudential distinctions is emphasized due to their importance in distinguishing between seemingly similar issues that are, in fact, different. This is crucial for jurists, judges, and Islamic jurisprudence teachers to avoid confusion when interpreting rulings, mistaking differences for agreements. The study aims to address this subtle and intricate aspect of Islamic jurisprudence, requiring detailed explanation and analysis. Key findings include the necessity of recognizing lesser-known Islamic jurists, including Maliki scholars, and appreciating their contributions to the school through their works, which still require further investigation and refinement. Among the most prominent is Sheikh Khalil, renowned for his famous compendium relied upon by later scholars in the Islamic world, particularly in Morocco. The study also highlights the rich content found in these works, such as objectives-based perspectives, justification of rulings, jurisprudential preferences, and distinctions, which were thoroughly examined in this study through "Al-Tawdhih Sharh Mukhtasar Ibn Al-Hajib."
