الملخص
ملخّص: لما كان للفروق الفقهية أهمية بالغة في التّمييز بين ظواهر الألفاظ وحقائق الأحكام، وكان لا يستغني عنها دراس الفقه، ولا المفتي، ولا مجتهد التّخريج، ولما وجدتُ من اعلام الجزائر من تناول هذا الفنّ، ارتأيتُ أن أكتب هذا البحث للتعريف بالفروق الفقهية، وبأحد أعلام الجزائر، ألا وهو الفقيه أبو إسحاق إبراهيم التجيبي التلمساني، الذي قام بتأليف موسوعة فقهية، سمّاها "تذكرة أولي الألباب في شرح التّفريع لابن الجلاب"، تميّزت بمنهج فقهي متكامل بذكر الخلاف العالي والنازل، والأدلّة، وأسباب الخلاف، والقول المشهور، والتّعليل، والتّنظير، كما برزت شخصيتُه بذكر الفروق الفقهية في معظم هذا الشّرح. هذا ما جعلني أكتبُ هذا البحث للتعريف بأبي إسحاق التلمساني، وشرحه، وكذا منهجيه الفقهي، ثم إبراز جانبا من جهده في الفروق الفقهي في باب العبادات. الكلمات المفتاحية: الفروق- الفقهية_ أبو إسحاق- التجيبي- التلمساني Summary The distinctions in jurisprudence are critically significant for differentiating between the superficial interpretations of language and the substantive realities of legal rulings. The study of jurisprudence, along with the roles of the mufti and the mujtahid, is inextricably linked to these differences. In light of my findings regarding prominent figures in Algeria who have engaged with this discipline, I have undertaken the task of composing this research to elucidate the variances in jurisprudence. This inquiry particularly focuses on the distinguished Algerian jurist Abu Ishaq Ibrahim al-Tijibi al-Tilimsani, who authored a jurisprudential encyclopedia titled "Tadhkirat Uli al-Albab fi Sharh al-Tafri' li-Ibn al-Jalab." This work is notable for its comprehensive jurisprudential perspective, as it addresses both significant and minor differences, alongside the relevant evidences, underlying reasons, prominent opinions, and the principles of reasoning and theorization. Al-Tilimsani's scholarship is particularly evident in his extensive treatment of the differences in jurisprudence throughout this exposition. Thus, this research aims to introduce Abu Ishaq al-Tilimsani, analyze his exposition, and delineate his jurisprudential methodology, with a specific focus on his contributions to the discourse on differences in jurisprudence, particularly within the realm of worship.
