نبتغي من خلال هذا البحث إلى تبيّن المشترك والمختلف بين ثلاثة علوم مهمّة وهي علم التاريخ وعلم الجريمة والفقه. كما سنسعى إلى فهم طريقة وصولهم للحقيقة وهو لبّ رحى العمل. أي طريق وصول المؤرخ والفقيه والمحقّق الجنائي للدليل وأساليب تتبّعهم للأثر ولو كان مندرسا أو ممحوّا أو ضبابيّا. إذا فهو بحث في ابستيمولوجيا المعرفة وعلم اجتماعها مع أخذ نماذج تفسيريّة راسخة وهي: المؤرّخ والفقيه والمحقّق الجنائي. ولهذا يهدف هذا البحث إلى دراسة العلاقة المنهجية والفكرية بين علم التاريخ والفقه وعلم الجريمة، من خلال تحليل التطورات التي شهدتها هذه العلوم في سياق مأسسة المعرفة والبحث عن الحقيقة عبر الأدلة والأثر. وقد تبيّن لنا استنتاج محوريّ وحيويّ: لا يمكن التفريق معرفيّا ومنهجيّا بين المحقّق الجنائي والمؤرّخ والفقيه فديدنهم ومنهجم الوصول للحقيقة عبر العثور على أدلّة ملموسة وراسخة وحاسمة فلا يمكن إصدار الحكم الفقهي أو القضائي أو التاريخي بدون دليل ثابت وقاطع. كما تشترك هذه المجالات في المنهج والتمشّي بطريقة شبه متطابقة. ويبقى الاختلاف فقط في طبيعة المرجعيّات والمدوّنات والمؤسسات الراعية. لكن يبقى الانسان ومصلحته هو الغاية والمنتهى، فهذه العلوم تبتغي حماية أرزاقه وحرماته (الجسديّة وغيرها)، وهذا هو الخيط الناظم الثاني. أي تشابه هذه العلوم في المنهج والغاية. Through this study, we aim to identify the commonalities and differences among three important disciplines: history, criminology, and jurisprudence. We will also seek to understand how each of these disciplines arrives at the truth, which is the very essence of their work. Specifically, we will examine the paths taken by the historian, the jurist, and the criminal investigator to uncover evidence, as well as the methods they employ to trace traces—even if those traces are faint, erased, or obscure. Thus, this is a study of the epistemology of knowledge and its sociology, drawing on established interpretive models: the historian, the jurist, and the criminal investigator. This research therefore aims to study the methodological and intellectual relationship between the history, jurisprudence, and criminology, by analyzing the developments these disciplines have undergone in the context of the institutionalization of knowledge and the search for truth through evidence and traces. We have arrived at a central and vital conclusion: it is not possible to distinguish, epistemologically or methodologically, between the criminal investigator, the historian, and the jurist, as their approach to uncovering the truth involves finding concrete, well-established, and decisive evidence; thus, no jurisprudential, judicial, or historical judgment can be issued without solid and conclusive evidence. These fields also share a methodology and proceed in a nearly identical manner. The only difference lies in the nature of their sources, codifications, and sponsoring institutions. However, humanity and its welfare remain the ultimate goal, as these sciences seek to protect people’s livelihoods and sanctities (physical and otherwise), and this is the second unifying thread. That is, the similarity of these sciences in methodology and purpose.
