Access to justice as a pivotal environmental procedural right for defending the collective interests of current and future generations, thereby achieving sustainable development. However, the diffuse, impersonal, and ricochet nature of environmental harm—notably pollution—has raised significant legal challenges regarding the requirements of standing and interest to sue. This study examines the procedural obstacles hindering individual environmental litigation to activate the right of access to justice. It analyzes collective actions (group actions) as the most effective mechanism for collective redress, focusing on their requirements and procedures under Algerian legislation and comparative systems, including French, American, and Canadian models as pioneering frameworks in this field.
