This study addresses the legal and economic controversy surrounding biological and genetic resources in light of the rapid advancements in biotechnology. The study aims to examine the problematic endeavors of technologically advanced nations to monopolize economic returns through the instrumentalization of intellectual property regimes, which has led to the emergence of biopiracy practices and a widening developmental gap with developing nations. Conversely, the study explores the efforts of provider states to assert their permanent sovereignty over natural resources and traditional knowledge, pursuant to the Convention on Biological Diversity (CBD). This legal framework imposes preventive mechanisms, notably Prior Informed Consent (PIC) and the fair and equitable sharing of benefits arising from the exploitation of these resources within international trade relations.
