Abstract

تهدف هذه الدراسة إلى فهم الإشكاليات القانونية المرتبطة بالعملات الرقمية، وذلك من خلال تتبع مفاهيمها وتكييفاتها القانونية والفقهية المختلفة، والنظر في مدى قابلية المنظومة التشريعية الجزائرية لاستيعاب إدماج الدينار الرقمي كعملة رسمية. وركّز التحليل على تتبع الطبيعة القانونية لهذه العملات، وذلك بتفكيك المفاهيم المتعلقة بها، وسبر الخلفيات التقنية والمالية التي أدت إلى ظهورها. Abstract: This study examines the legal challenges and regulatory prospects of digital currencies in Algeria, highlighting their legal nature, the risks they pose to monetary sovereignty, and the potential for introducing a state-backed digital dinar. Through a comparative approach, it draws lessons from pioneering experiences such as those of China, Sweden, and the European Union to propose a robust regulatory framework tailored to Algeria.
