Abstract: This study examines the use of algorithms in the award of public procurement contracts, particularly in the evaluation, ranking, and exclusion of bids. It argues that digital transparency is not limited to publishing notices or tender documents, but also requires that the basis of the award decision be understandable, traceable, and verifiable, without unjustified disclosure of trade secrets or protected data. The article develops the concept of “auditable compliance” as a governance framework linking public procurement law, business law, and digital risk management. This framework turns transparency from a formal requirement into an evidentiary practice based on documented criteria, operational logs, a digital decision file, effective human review, and clear responsibilities for technology providers. Drawing on the Algerian legal framework governing public procurement, digitalization, and trust services, and on selected comparative trends, the study concludes that the legality of algorithmically supported award decisions depends on explainability, auditability, documentation, reviewability, and contestability. These requirements support responsible digital governance that protects competition and strengthens trust in public procurement.
