الملخص
نص المشرع الجزائري في قانون الأسرة على شروط تعدد الزوجات لاستصدار الترخيص القضائي الذي يدخل ضمن العمل الولائي لقاضي شؤون الأسرة. هذه الشروط جاءت غير مسايرة للحكم الشرعي لتعدد الزوجات في الإسلام، وتثير العديد من الإشكالات أمام قاضي شؤون الأسرة والتي لها أثرها السلبي على الترخيص القضائي لتعدد الزوجات، وعلى صحة أفراد الأسرة والمجتمع. The Algerian legislator, in the Family Code, has stipulated specific conditions for polygamy in order to obtain judicial authorization, which falls within the discretionary (non-contentious) jurisdiction of the Family Affairs Judge. These conditions are not consistent with the Islamic legal ruling on polygamy and raise numerous issues before the Family Affairs Judge, which negatively affect the granting of judicial authorization for polygamy, as well as the well-being of family members and society
