This study examines the legal nature of the plea of inadmissibility in Algerian legislation, as a legal instrument aimed at denying the plaintiff's right to litigate due to the absence of judicial protection requirements, such as standing (qualité) and interest (intérêt). The study highlights the autonomy of this plea from both substantive and formal (procedural) pleas. It also clarifies the instances of inadmissibility related to public order (ordre public) which the judge raises ex officio, and those not related to public order which are invoked solely by the litigants. Furthermore, the study reviews the impact of the judgment rendered on the plea of inadmissibility on the course of litigation and the exhaustion of the court's jurisdiction upon adjudication. Finally, the study concludes by identifying a terminological overlap in certain legislative texts between "inadmissibility" and "nullity," while proposing the codification of the provisions for the plea of unconstitutionality within the Civil and Administrative Procedures Code.
