جريمة الإعتداء على النظام المعلوماتي الجمركي Alces ودور الهيئات الإدارية المتخصصة في الوقاية منها

الملخص
إن حتمية تجسيد الجزائر لسياسة الإنفتاح التجاري الخارجي ومسايرتها لمتطلبات المؤسسات الدولية لتقديم خدمات ذات نوعية وسريعة بالنسبة للمتعامل الإقتصادي في مجال الإستيراد والتصدير، كان دافعًا للإهتمام بقطاع الجمارك عن طريق عصرنته حتى يواكب التطورات ويواجه المخاطر، وفي هذا الإطار تم الإعتماد على أنظمة معلوماتية آخرها نظام معلوماتي جديد يتجلى في نظام ALCES يعمل على معالجة المعطيات الجمركية بشكل آلي ولكن بالرغم من الحماية الفنية التي يمتاز بها إلا أنه لم يسلم من اختراقه بمختلف الوسائل الإلكترونية مما أضحى يُشكل خطرًا على أهم مؤسسة تابعة للدولة، هذا ما دفع بالمشرع إلى تجريم هذه الأفعال بنص خاص مستمد من قانون الجمارك، وبالمقابل وضع آليات وقائية للتصدي لها كما استحدث أجهزة إدارية متخصصة للتصدي لهذه الجريمة أهمها المركز الوطني للإشارة ونظام المعلومات الجمركي والهيئة الوطنية للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال. The inevitability of Algeria's policy of openness to foreign trade and its alignment with the requirements of international institutions to provide quality and fast services to economic operators in the field of imports and exports motivated the interest in the customs sector by modernizing it to keep pace with developments and face risks. information systems have been adopted, most recently a new information system ALCES, which automates the processing of customs data, but despite its technical protection, it has not been spared from hacking by various electronic means, which has become a threat to the most important state institution. This prompted the legislator to criminalize these acts in a special text derived from the Customs Code and, in turn, to establish preventive mechanisms to deal with them, and to create specialized administrative bodies to combat this crime, in particular the National Signals Center, the Customs Information System and the National Authority for the Prevention of Crimes Related to Information Technology Offences.
