الملخص
إنّ العالم اليوم يشهد تطوّرا وتقدّما بوتيرة مذهلة في تكنلوجيا المعلومات الحضارية ووسائل الاتّصال الحديثة، فلا شكّ أنّها أحدثت طفرة حضارية في شتى المجالات في العصر الحديث، ومن بين المزايا الّتي أحدثتها في زماننا سرعة إبرام المعاملات المالية، وقد أنتج ذلك صورا وأشكالا عديدة من المعاملات الماليّة المعاصرة لم تكن معهودة فيما سبق، منها عقد الصّرف الإلكتروني. فقد اشتملت هذه الدّراسة تحت عنوان: «أحكام عقد الصّرف الإلكتروني المباشر دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري» على بيان حقيقة عقد الصّرف الإلكتروني ومشروعيّته، حيث أنّه كان لزاما على العلماء أن يبيّنوا أحكامه للمسلمين ويعرّفونهم بالحلال والحرام منها، خاصّة مع تعدّد أنواعه وطرق إبرامه، كما يلقي الضّوء على صيغ وصور عقد الصّرف الإلكتروني ووسائل الدّفع الإلكترونيّة المعاصرة. Abstract: Today's world will experience development and progress at an astonishing pace in the various fields of cultural information technologies and modern means of communication. There is no doubt that they have made a civilizational leap in various fields in the modern era and have brought many benefits. In today's world, it is the speed of concluding financial transactions, and this has given rise to many forms of financial transactions. Modernity was not common in the past, including the electronic exchange contract. This study was included under titled : « Rulings Of a Direct Electronic Currency Exchange Contracts from Two Perspectives: Islamic Jurisprudence and Algerian Law ».Consequently, it has become essential for scholars to provide a comprehensive understanding of these contracts within the framework of Islamic jurisprudence, clearly distinguishing between what is permissible “حلال” and what is forbidden “حرام”. seeks to examine and clarify the different forms and types of electronic currency exchange contracts, along with modern electronic payment methods, from the perspectives of both Islamic jurisprudence and Algerian legal principles
