Abstract Article 94 of the 2020 Constitutional Amendment regulates the cases of the temporary and permanent impediment of the President of the Republic, distinguishing between them and determining the legal effects of each situation. The impediment is limited to the President’s health condition, and both cases are subject to the same procedural requirements. The Constitutional Court is responsible for raising the issue and proposing to Parliament the declaration of the impediment, while the authority to announce such a situation lies exclusively with Parliament meeting in both chambers. The key difference between the two lies in the time limits distinguishing the temporary vacancy from the definitive vacancy of the Presidency. As a first consequence of declaring the impediment, the Speaker of the Council of the Nation assumes the office of Head of State on an interim basis to ensure the continuity of the State’s highest constitutional institution. He exercises the powers defined in Article 95 of the Constitution. If the vacancy of the Presidency coincides with an impediment affecting the Speaker, and this concurrence is confirmed by a three-quarters majority of the Constitutional Court, the President of the Constitutional Court assumes the functions of Head of State.
