Legal Protection Of Children With Disabilities From Bullying: Navigating Social Disorder And Legal Gaps

Abstract
تعرض هذه الدراسة مشكلة التنمر على ذوي الاحتياجات الخاصة التي تقف حاجزا أمام سياسة الادماج التي قررتها المواثيق الدولية والقوانين الداخلية للدول، وعليه، سيتم البحث في هذه الدراسة فيما إذا كان التنمر على الطفل المعاق هو مجرد استفحال لظاهرة اجتماعية لأسباب متعددة، أم أن هذا التداعي هو مسألة تقصير من قبل النصوص القانونية. وتم التوصل الى أن الحماية المقررة لا تعدو لأن تكون نصوصا عامة إما تخص الطفل عموما وإما الشخص المعاق مهما كان سنه، وفي أحيان كثيرة تعوزها الدقة والوضوح، ما يدعو الى ضرورة إفراد المعاق الطفل بحماية خاصة من التنمر وتمييزه عن باقي الاعتداءات على غرار بعض التشريعات كالمصري. Abstract : This study addresses the issue of bullying directed at individuals with special needs, which poses a barrier to the implementation of inclusive policies established by international charters and domestic legal frameworks. Accordingly, the study seeks to investigate whether bullying of children with disabilities merely reflects the intensification of a social phenomenon driven by multiple factors, or whether such a situation stems from shortcomings inherent in the relevant legal provisions. The findings reveal that the legal protection provided is no more than general provisions, either pertaining to children in general or to persons with disabilities regardless of age. These provisions often lack precision and clarity, which underscores the need to grant children with disabilities specific legal protection against bullying, distinguishing it from other types of assault, as is the case in certain legal systems such as the Egyptian one.
