الحماية القانونية للطفل من العنف الجنسي في ظل القانون24-06 المعدل والمتمم لقانون العقوبات

الملخص
تشير الدراسات إلى أن الأطفال دون 18 سنة يكونون عرضة لخطر الاعتداءات الجنسية القسرية وأن الملايين من الأطفال يتم استغلالهم في المواد الإباحية والدعارة حول العالم، ولكن لا تتوفر تقديرات دقيقة حول العنف الجنسي ضد الأطفال بسبب نقص البيانات، حيث يتم إخفاء النسب الحقيقية له بسبب طبيعته الحساسة وغير القانونية، إذ لا تقوم العائلات بالإبلاغ عن هذه الحالات بسبب الخوف ووصمة العار، وغياب الثقة في السلطات. ويترتب على العنف الجنسي عواقب نفسية واجتماعية خطيرة ما يدفع للبحث في أسبابه وعن حلول وآليات لوضع حد لهذا النوع من الاعتداء من خلال تحليل الاليات الدولية والوطنية في إطار التعديلات المتتابعة لقانون العقوبات خاصة، لاسيما أنها جرائم تقع على فئة مستضعفة في المجتمع قاصرة قانونا. Abstract : Studies appreciate that children under 18 years old are at risk of forced sexual intercourse or other forms of forced sexual acts. Millions of children are exploited in prostitution, pornography around the word, but accurate estimates on sexual violence against children are unavailable due to the lack of data, as the true magnitude of sexual violence is hidden because of its sensitive and illegal nature, and therefore families do not report cases because of the fear and stigma, and luck of trust in authorities. Sexual violence has serious psychological and social consequences, which prompted us to search for its causes and for solutions and mechanisms to put an end to this type of assault by analyzing international and national mechanisms within the framework of successive amendments to the Penal Code in particular, especially since they are crimes committed against a vulnerable group in society that is not legally mature.
