النص القانوني بين خاصية الثبات ومواكبة التطور

الملخص
الملخص: النص القانوني هو الإطار المنظم للمجتمع في ظل دولة القانون، فهو الأساس الديمقراطي المعتمد لضمان تناغم اجتماعي قائم على حماية الحقوق والحريات، وتحديد الالتزامات والجبر على الإتيان بها. رغم بساطة هذا الطرح، إلا أن فكرة ضمان مواكبة النص القانوني لما يعرفه المجتمع من تطور تضع المشرع على المحك، ذلك أن القانون يشرع ليمتد عبر الزمن إلى غاية ظهور مستجدات ضمن البيئة التي يسري فيها، تستوجب تعديله حرصا على تحقيق ما شرع له، ومن هنا تبرز فكرة الحاجة إلى ضرورة ضمان التناغم بين النص القانوني وبيئته، ذلك أن النص لم يشرع إلا بعد جهد كبير فكري ومادي وفق إجراءات شكلية وموضوعية دقيقة، وتناغم كلي للمنظومة القانونية، مما يستوجب حرص المشرع على الاخذ بعين الاعتبار كل المستجدات على تنوعها وتعدد عواملها عند تحرير النص الجديد، وتناغمه مع باقي النصوص القانونية الأخرى السارية دون أي تعارض أو تضارب في محتواها وأهدافها. Abstract: Legal text is considered as the organized framework of social life. Therefore, it is the democratic basis feature to ensure the desired social harmony through the regulation and protection of rights and freedoms on one hand, and the determination of obligations and enforcement thereof on the other, The above brief introduction suggests that enacting legal text requires significant effort, including multiple formal and objective stages and procedures to maintain its continuity and stability, without setting a predefined duration of application. The principle is that it endures over time to accomplish its intended objectives, staying effective until changes in the environment demand amendments or abolishment, These factors differ and range from political, social, economic, cultural, or other considerations that must be taken into account when enacting any legal text. However, this article will focus on the most main factors that serve the idea under study, which we believe are the most impactful in enacting or amending any legal text
