العقار المنجمي في التشريع الجزائري بين الإستغلال والحماية

الملخص
يتناول المقال دراسة تحليلية للقانون رقم 25-12 المنظم للنشاطات المنجمية، والذي أعاد تحديد مفهوم العقار المنجمي ونطاق تطبيقه. وركّزت الدراسة على سعي المشرّع إلى تحقيق التوازن بين استغلال الثروات المنجمية وجذب الاستثمار من جهة، وضمان حماية البيئة والموارد الطبيعية من جهة أخرى. كما يبرز المقال آليات منح السندات والرخص المنجمية، وشروط الاستثمار، وآليات الرقابة الإدارية والجزائية التي وضعت لمواجهة الاستغلال غير المشروع. وختمت الدراسة بأن نجاح هذا القانون مرتبط بفعالية تطبيقه ومواكبته لمتطلبات التنمية المستدامة. The article provides an analytical study of Law No. 25-12, which governs mining activities in Algeria and redefines the concept and scope of mining property. The study focuses on the legislator’s efforts to achieve a balance between the exploitation of mineral resources and the promotion of investment, on the one hand, and the protection of the environment and natural resources, on the other. It further highlights the mechanisms for granting mining titles and licenses, the conditions for investment, and the administrative and criminal oversight measures established to prevent unlawful exploitation. The study concludes that the effectiveness of this law depends largely on its practical implementation and its alignment with the principles of sustainable development..
