الملخص
ملخص: ضمن إطار الشـراكة بين القـطاعين العـام والخـاص، تـبنت السلطـة التنظيمية بموجـب المرسوم التنفيذي رقم 18-199 المتعلق بتفويض المرفق العـام، منهج ثنائي لإبرام اتفاقيات تفويض المرفق العام، قائـم على أساس التفريق بين الطلب على المنافسة الذي يعد القاعدة العامة، والتراضي بنوعيه الاستشـاري والبسـيط الـذي يشكل الاستثناء. أمـــام هذا التنــوع في صيـــغ إبرام اتفاقيات تــفويض المرفق العام؛ فإن السلــــــــــطة المفوضـــــة ملزمة بضمـــــان مبـــادئ المنافسة، والشفافية، والمساواة في إبرام هذه الاتفاقيات، لا سيما في حالة تــفويضها للمرفق العام بــواسطـــة التراضي الذي يجعلها تتــمتع بقــدر من السلطـــة التقديريــــة في اختيـــار المفوض له، على خلاف الطلب على المنافسة، والذي يــــــمكن السلطة المفوضة من انتقاء أفضل العروض من خلال تقييدها بجملة من الضوابط القانونية في إطار المشروعية الإدارية. Abstract: Within the framework of public-private partnerships, the regulatory authority, under executive decree no. 18-199 concerning the delegation of public services, adopted a dual approach for concluding public service delegation agreements. This approach is based on the distinguishing between competitive tendering, which is the general rule, and negotiated procedures, in their two forms negotiated procedure after prior consultation and simple negotiated procedure which constitute exceptions. In light of the diversity of procedures for awarding public service delegation contracts, the delegating authority is obligated to ensure the principale of competition, transparency, and equality in the contracting process, especially in cases where the delegation is awarded through negotiated procedures, which grants it a degree of discretionary power upon the delegating authority in selecting the service provider. In contrast, competitive tendering which allows the best offers by adhering to a set of legal controls within the framework of administrative legality.
