International Human Rights Law Standards In The Face Of Climate Change: What Effectiveness?

Authors : Kacem Lamia .

Abstract

Abstract: The immense challenges posed by climate change to human rights have intensified efforts to identify and respond to risks. Against this backdrop, a movement has emerged that advocates considering the intersection between international law and climate change, particularly with regard to human rights. The aim is to explore the possibility of leveraging these intersections to mitigate the impacts of climate change from a rights-based perspective. This research paper therefore aims to examine the potential of applying the findings of international human rights protection to effect effective and equitable change within the context of climate law. Despite considerable efforts by various UN bodies and mechanisms to activate this approach and achieve positive outcomes, the study concludes that the fragility of legal systems related to human rights has been highlighted. These systems must be adapted to address the challenges posed by climate change, and efforts must be directed towards international cooperation to tackle the phenomenon.
