Although international human rights law concerning minorities provides a complex system of provisions that may affect the status of religious groups, the issue remains unsettled and under study. The definition of minorities in general, and religious minorities in particular, is undergoing significant evolution. Accordingly, this paper seeks to shed light on the comprehensive legal framework established under the United Nations and the approach adopted by most human rights bodies and committees to redefine “religious minority” in light of the intersections between different categories of human rights and minority rights. This is done by analyzing the legal sources that protect religious minorities and focusing on a specific issue: the extent to which the cultural identity of the group and the individuals ensures a type of protection for this category of minority. The study concludes that applying a comprehensive approach combining individual and collective rights, recognizing the right to cultural identity on both the individual and collective levels, and mandating positive measures has allowed for better protection of religious minorities.
