واقع الهجرة غير الشرعية: التعاطي القانوني للمسألة

الملخص
تعالج هذه الدراسة الإطار القانوني المنظم لظاهرة الهجرة غير الشرعية في تونس، في ظل تصاعد هذه الجريمة وتحوّلها إلى نشاط إجرامي منظم عابر للحدود. وتهدف إلى تقييم مدى مواكبة التشريع التونسي للتطورات التي عرفتها هذه الظاهرة، ومدى انسجامه مع الالتزامات الدولية في مجال مكافحة تهريب المهاجرين وحماية حقوق الإنسان. واعتمدت الدراسة على المنهج التحليلي للنصوص القانونية الوطنية، مع الاستئناس بالمقاربة الدولية. وتخلص الدراسة إلى أن المشرّع التونسي قد خطا خطوات هامة في تكريس مقاربة زجرية، غير أنّها لا تزال تعاني من بعض القصور التشريعي والتطبيقي، بما يستوجب مراجعات تشريعية وتدعيم الآليات الوقائية. كلمات مفتاحية: الهجرة غير الشرعية- القانون التونسي- القانون الدولي للهجرة- تهريب المهاجرين- الأمن الوطني- القانون الدولي للهجرة. This study examines the legal framework governing irregular migration in Tunisian law, in light of the increasing complexity and growth of this phenomenon, which has evolved into a form of transnational organized crime. The study aims to assess the extent to which the Tunisian legislator has succeeded in establishing an effective legal framework capable of addressing irregular migration, while balancing the requirements of national security and Tunisia’s international obligations in the field of migration and human rights. The research adopts a legal-analytical approach based on the examination of national legislative texts, with reference to relevant international legal instruments. The study concludes that, despite significant legislative efforts undertaken by the Tunisian legislator to combat irregular migration, the existing legal framework still suffers from certain legislative and practical shortcomings, which call for further legal reforms and the strengthening of preventive and protective mechanisms.
