Authors : Benhida Mohammed .

Abstract

Abstract The doctrine of independent administrative acts is among the principles recognized by the French Conseil d'État. It refers to administrative decisions issued autonomously within the framework of a composite legal process, which may be subject to annulment proceedings independently. This study highlights the importance of examining the rationale behind allowing such acts to be challenged through annulment as a means of reinforcing oversight over administrative conduct, particularly in the domain of public procurement. It also serves to safeguard the principle of legality and protect third-party rights within the contractual process by enabling challenges to any unlawful administrative decisions.
