Artificial Intelligence And Administrative Decisions: Rethinking The General Theory Of Administrative Acts In The Age Of Algorithms

Authors : Bentifour Abdelbasset . Ferouani Amal Linda .

Abstract

This paper explores the legal implications of integrating artificial intelligence (AI) into administrative decision-making. As public authorities increasingly rely on AI systems, traditional administrative law—rooted in human discretion—faces conceptual and practical challenges. The study analyzes how AI interacts with the legal elements of administrative acts, including competence, cause, and purpose. It also examines issues of transparency, legality, and accountability, particularly in cases of algorithmic error. Through a comparative and analytical approach, the paper argues for doctrinal reform to accommodate AI within administrative law.
