ضمانات المقررة للضحية لتنفيذ الحكم الجزائي في الشق المدني

الملخص
يعد تنفيذ الحكم في شقه المدني المرحلة الأخيرة التي تتوج بها الإجراءات القضائية الرامية إلى تمكين الضحية من الحصول على التعويضات المدنية المقررة لها بموجب الحكم الجزائي. وتعتبر هذه المرحلة من أهم المراحل التي يتجسد فيها حق الضحية في التعويض، باعتباره مقابلا للأذى الذي لحق بها جراء الجريمة المرتكبة. ورغم أهمية هذه المرحلة، إلا أن ضمان اقتضاء الضحية لحقها يتطلب وسائل ضغط فعالة، ولهذا نص المشرع الجزائري على جملة من الآليات القانونية التي تهدف إلى الزام المحكوم عليه بدفع التعويضات المستحقة للضحية. The enforcement of the civil part of the criminal judgment constitutes the final stage that crowns the judicial procedures aimed at enabling the victim to obtain the civil compensation granted under the criminal judgment.This stage is considered one of the most crucial phases in which the victim’s right to compensation is realized, as it represents redress for the harm suffered as a result of the committed crime. Despite the importance of this stage, ensuring that the victim effectively obtains their right requires effective enforcement mechanisms. For this reason, the Algerian legislator has established a set of legal mechanisms aimed at compelling the convicted person to pay the compensation due to the victim.
