Authors : Mezaache Riadh .

Abstract

Abstract This study aims to clarify the legislative and judicial mechanisms to resolve the problems raised by customary bonds despite the ease of their issuance, speed of circulation, and low costs, which expanded the scope of dealing with them, but they are marred by many defects that make them devoid of evidence, and despite that, individuals still rely on them in their real estate transactions, but they quickly face problems that deprive them of the benefit of their real estate ownership, so this study focused on most important solutions that can contribute to their settlement, and the study concluded that despite law requires that they have no legal value, so the Algerian legislator and judiciary approved a set of mechanisms through which the status of these contracts can be settled.
