The International Criminal Court And Its Judicial And Administrative Bodies

Authors : Mezaache Riadh .

Abstract

Abstract : The International Criminal Court represents the first lasting international judicial institution, coming into existence when the Rome Statute took effect on July 1, 2002. Its core mission is to deliver justice for those affected by armed conflicts and hold accountable individuals responsible for the world's gravest crimes. For the Court to function effectively, it must have a solid judicial and administrative framework as set out in parts of the Rome Statute, specifically in Chapter Four (notably Article 34) and Chapter Eleven (Article 112). The Court’s structure revolves around a central Presidency and comprises three core divisions: the Pre-Trial Chamber, the Trial Chamber, and the Appeals Chamber. This hierarchical design aligns with the conventional two-tier judicial framework found in numerous legal systems, where initial adjudication occurs at the trial level, followed by a potential appellate review to ensure procedural fairness and legal accuracy. Given that the Court's judicial components alone do not suffice to exercise its full mandate, the International Criminal Court complements them with additional bodies. In addition to the General Assembly of States Parties—the primary hub for administrative, financial, and policy-making functions—the Court’s framework incorporates the Office of the Prosecutor. This office serves a pivotal function in overseeing the procedural aspects of cases and safeguarding the integrity of judicial processes at every stage. This multi-faceted organizational setup underscores the Court's commitment to balancing both the judicial and administrative aspects of international justice, thereby enhancing its overall effectiveness.
