الملخص

تعد جريمة الإتجار بالبشر من أخطر الجرائم المستحدثة، فهي ذات طابع وطني ودولي كونها من أبرز مظاهر الجريمة المنظمة عبر الوطنية، و نظرا لتداعياتها الخطيرة ولخصوصيتها قام المشرع الجزائري بإلغائها من نصوص قانون العقوبات لعدم كفايتها في التصدي لها، و إصدار القانون رقم: 23-04 المؤرخ في: 07 مايو 2023 المتعلق بالوقاية من الإتجار بالبشر ومكافحته في إطار سياسة جنائية حديثة، حيث كرّس فيه جملةً من الآليات لمواجهتها، من أبرزها الآليات الموضوعية التي تهدف إلى الكشف عن هذه الجريمة حتى قبل وقوعها، كما تساعد في كشف المتورطين فيها. وعليه سنحاول في هذه الورقة البحثية تسليط الضوء على هذه الآليات على ضوء القانون: 23-04، وإبراز الثغرات القانونية ذات الصلة إن وجدت. Human trafficking is considered one of the most dangerous emerging crimes, as it has both national and international dimensions, being one of the most prominent forms of transnational organized crime. Due to its serious consequences and unique nature, the Algerian legislator removed it from the provisions of the Penal Code, deeming them insufficient to address it effectively. Instead, Law No. 23-04, dated May 7, 2023, was issued concerning the prevention and fight against human trafficking, as part of a modern criminal policy. This law introduced several mechanisms to combat this crime, most notably proactive measures aimed at detecting human trafficking even before it occurs, and assisting in identifying those involved. .Accordingly, in this research paper, we will attempt to shed light on these mechanisms in light of Law No. 23-04, and highlight any related legal loopholes, if they exist .
