Abstract: This study critically examines the reconfiguration of the concept of patent protection in the era of artificial intelligence, wherein AI has emerged as a principal actor in the innovation ecosystem, thereby generating unprecedented legal and philosophical challenges for conventional legislative frameworks. The findings reveal that the majority of national and international legal systems—including Algerian legislation—continue to require the inventor to be a natural person, and categorically refuse to recognize artificial intelligence as an autonomous inventor, despite the intensifying scholarly and judicial debate regarding the necessity to modernize these provisions. The research further demonstrates that high-profile cases, such as "DABUS", have exposed significant divergences among legal systems and underscored the pressing need to develop new standards that account for the unique characteristics of AI-generated inventions. The study recommends updating the statutory definition of “inventor” within national legislation to encompass AI-assisted innovations, provided that human oversight is maintained as a legal and ethical safeguard. It also advocates for the establishment of precise and transparent criteria for assessing novelty and inventive step in intelligent inventions, the enhancement of institutional cooperation, and the adoption of international best practices—while remaining attentive to the specificities of the Algerian legal environment. These conclusions open promising avenues for future research, including the development of unified Arab legislative models and the creation of novel legal and technical mechanisms for evaluating and allocating responsibility for innovations in the age of artificial intelligence.
