إعادة تشكيل مفهوم حقوق المؤلف في ظل الذكاء الاصطناعي Reshaping The Concept Of Copyright In The Age Of Artificial Intelligence

الملخص
تتناول هذه الدراسة التحديات القانونية والفلسفية التي يفرضها الذكاء الاصطناعي التوليدي على مفهوم حقوق المؤلف، في ظل عجز التشريعات التقليدية عن استيعاب الإبداعات غير البشرية أو تلك التي تولد بمساعدة الذكاء الاصطناعي. تبرز الإشكالية من خلال تعارض المبادئ القانونية القائمة على "المؤلف البشري" مع قدرات التقنية الحديثة، ما يستدعي إعادة النظر في أسس الحماية القانونية للمصنفات في البيئة الرقمية الجديدة، مع التركيز على الفراغ التشريعي في الجزائر والعالم العربي، وصعوبة تحديد صفة المؤلف وتوزيع الحقوق بين الإنسان والآلة. تعتمد الدراسة على المنهج التحليلي المقارن لتحليل النصوص القانونية والاجتهادات القضائية الوطنية والدولية، مع استعراض تجارب براءات الاختراع لتوضيح أن إشكالية "المؤلف البشري" تنسحب على كافة مجالات الملكية الفكرية. تخلص الدراسة إلى ضرورة إعادة تشكيل المفاهيم القانونية عبر تعديل التشريعات وتطوير آليات تقنية وقضائية متخصصة، لضمان حماية فعالة لحقوق المبدعين في عصر الذكاء الاصطناعي، مع الحفاظ على التوازن بين تشجيع التطور التكنولوجي وحماية الإبداع البشري. This study addresses the legal and philosophical challenges that generative artificial intelligence poses to the concept of copyright, given the inability of traditional legislation to accommodate non-human creations or those generated with the assistance of artificial intelligence. The core issue arises from the conflict between legal principles based on the "human author" and the capabilities of modern technology, which necessitates a reconsideration of the foundations of legal protection for works in the new digital environment—with a particular focus on the legislative gap in Algeria and the Arab world, and the difficulty of defining authorship and distributing rights between humans and machines. The study employs a comparative analytical approach to examine national and international legal texts and judicial precedents, while also reviewing patent cases to demonstrate that the issue of the "human author" extends across all fields of intellectual property. The study concludes with the necessity of reshaping legal concepts through legislative amendments and the development of specialized technical and judicial mechanisms to ensure effective protection of creators’ rights in the era of artificial intelligence, while maintaining a balance between encouraging technological advancement and protecting human creativity.
