الملخص
في ظل تزايد مطالب تحسين أداء الأنظمة الإدارية و تطوير القضاء الإداري بما يتناسب مع المعايير العالمية لحقوق الإنسان، يأتي هذا البحث لدراسة موضوع عوائق حماية حقوق الأفراد من تعسف الإدارة في المنظومة القضائية الجزائرية. في هذه البحث، سيتم بيان مفهوم تعسف الإدارة بالسلطة، بالإضافة إلي تحديد النقائص التي تعتري الضمانات المتوفرة في النظام القضائي الإداري الجزائري لحماية حقوق الأفراد عند التنازع مع الإدارة العامة. كما يتناول البحث أهم أوجه قصور آليات الرقابة القضائية و مظاهر محدودية السلطات الممنوحة للقاضي الإداري. Abstract: In light of the increasing demands to improve the performance of administrative systems and develop administrative judiciary in line with international human rights standards, this research comes to study the issue of obstacles to protecting individuals' rights from administrative arbitrariness in the Algerian judicial system.. This research will explain the concept of administrative abuse of power, in addition to identifying the shortcomings in the guarantees available in the Algerian administrative judicial system to protect individual rights in disputes with the public administration. The research also addresses the most significant shortcomings of judicial oversight mechanisms and the limited powers granted to administrative judges.
