النّقود الرّقمية الإلكترونية في المعاملات التّجارية الحديثة Digital Electronic Money For Modern Commercial Transactions

الملخص

الملخص: تهدف الدّراسة إلى تحليل دور النّقود الرّقمية في تسهيل المعاملات من جهة، وتحليل الضوابط القانونية لاستخدامها. إضافة إلى عرض بعض النّماذج المتداولة منها، خاصّة في الدّول المتقدّمة التي حقّقت فيها رقمنة النّقود مكاسب اقتصادية كثيرة. بعد تقديم مفهوم النّقود الرّقمية وعرض نماذج منها، وتحليل تعاملاتها من وجهة نظر قانونية باعتماد المنهج التّحليلي، توصّلت الدّراسة إلى أنّ هذه النّقود الجديدة أساس التّجارة الإلكترونية الحديثة، لما تتيحه من سرعة وسهولة الدّفع، وكذلك تقليل المخاطر النّاجمة عن العملة الورقية من خلال تقنيات التّشفير والحماية العالية. غير أنّ هذا لا يعفي من البحث في صناعة الأطر القانونية الأكثر نجاعة، وتوحيد الجهود الدّولية في هذا الشّأن. Abstract: This study aimed at analyzing the role of digital money as a modern mechanism for e-commerce in facilitating transactions and the legal regulations governing its use due to the risks that may entail. It also displays some of its used models, particularly in developed countries where digitizing money has realized numerous economic benefits and gains. After having defined the digital money, presenting its models, and analyzing its transactions from a legal perspective using an analytical approach, the findings showed that this new form of money is the basis of modern e-commerce. It enables faster and more convenient payments and reduces risks associated with paper money through encoding and advanced protection technologies. However, this does not eliminate the need to create more effective legal frameworks and unify international efforts in this regard.
