This study examines the ICC’s role in addressing the issue of child soldiers, while simultaneously attempting to uncover the legal and procedural loopholes that could hinder its ability to provide effective protection for them. This study uses an inductive and analytical approach. While the Rome Statute criminalizes the recruitment of children under fifteen, it neglects comprehensive protection for those aged fifteen to eighteen, The Court’s jurisdiction is hindered by state consent requirements and politically charged Security Council referrals, limiting its reach and impact. thus restricting its effectiveness. The study calls for fundamental reform of the international criminal system, including raising the age of child soldiers covered by protection to 18. Without serious reforms, the court will remain a symbolic tool, unable to protect children from the militarization of childhood.
