واقع الصيرفة الإسلامية في الجزائر وتحدياتها على ضوء القانون النقدي والمصرفي رقم 23- 09

الملخص
تهدف هذه الدراسة إلى الوقوف على واقع الصيرفة الإسلامية بالجزائر بعد صدور القانون النقدي والمصرفي ومعرفة أهم تحدياتها على ضوئه. وقد تم استخدام المنهج الوصفي وأداة التحليل لوصف وتحليل واقع وتطور الصيرفة الإسلامية، إضافة إلى تحليل مختلف تحدياتها. وقد تم التوصل إلى مجموعة من النتائج أهمها، أن هذا القانون يؤسس لقاعدة قانونية للصيرفة الإسلامية في الجزائر، ويمكِّن من تعبئة الادخار ومحاربة الاكتناز، وسيساهم في إضافة خدمات للصيرفة الإسلامية إضافة إلى تلك الموجودة سابقا من مصارف إسلامية وشبابيك، وبالتالي تطوير نظام مالي إسلامي بالجزائر. ومن النتائج المتوصل إليها كذلك، أن السوق المصرفية الإسلامية سوقا واعدة بلغ حجمها عام 2023 ما قيمته 800 مليار دج. ورغم ذلك لا يزال معدل الاكتناز مرتفعا ما يجعل من الضروري مواجهة التحديات التي تعيق تحقيق أهداف هذ القانون، ومنها عدم تكييف القوانين الأخرى كالقانون الجبائي، القانون المدني، والقانون التجاري. The aim of this research is to examine the reality of Islamic banking in Algeria following the issuance of the Monetary and Banking Law and attempt to address its most important challenges in light of this law. A descriptive approach and analytical tools were used to describe and analyze the reality and growth of Islamic banking, as well as its various challenges. A set of conclusions were reached, the most important of which is that this law establishes a legal basis for Islamic banking in Algeria, enables the mobilization of savings and combats hoarding. It will contribute to adding Islamic banking services to those already existing, such as Islamic banks and retail outlets, thus developing an Islamic financial system in Algeria. Another conclusion reached is that the Islamic banking market is a promising market, with a size estimated at 800 billion dinars in 2023. Despite this, the hoarding rate remains high, making it necessary to address the challenges that hinder the achievement of this law's objectives, including not adapting other laws other laws, such as tax law, civil law, and commercial law.
