Authors : Abdi Youba Abdeladim . Maazouz Rabie .

Abstract

This study examines religious freedoms and minority rights in Algeria, outlining the constitutional and legal basis for freedom of belief and religious practice, and the evolution of their protection in Algerian constitutions up to the 2020 Constitution. It also examines the rights of minorities and guarantees for their protection, and highlights the role of the Constitutional Court in monitoring the constitutionality of laws, interpreting the provisions of the Constitution, and resolving disputes between authorities. The study focuses on the Court's contribution to protecting these rights and freedoms, analyzing the mechanisms for notification and plea of unconstitutionality and the procedural restrictions associated with them, and their impact on the effectiveness of constitutional oversight and achieving a balance between freedom of belief and respect for law, public order, and national constants, ensuring the preservation of fundamental rights, equality, and non-discrimination.
