التحوّل الرقمي للقرار الإداري: بين حداثة التنظير وتحدّيات التطبيق

الملخص
يعدّ التحوّل الرقمي لنشاط الإدارة الحديثة توجّهاً حتمياً، فرضته متطلبات مسايرة وتيرة التطوّر التكنولوجي والتقني. وقد أدّى هذا التحوّل إلى بروز صور جديدة من أشكال التصرّفات القانونية الإدارية، من بينها القرار الإداري الإلكتروني، بصفته صورة القرار الإداري التقليدي في البيئة الرقمية. وبالرغم من مزايا التوجّه الرقمي في مجال القرارات الإدارية، إلاّ أنّه يثير تحدّيات قانونية معقّدة من الناحية النظرية، تتعلّق بغموض مفهوم القرار الإداري الإلكتروني وصعوبة تعريفه، كما يطرح إشكالات قانونية متعدّدة من الناحية العملية، في ظل عدم ملاءمة إخضاعه للمنظومة القانونية التقليدية. لذلك، ولضمان الفعالية الرقمية المنشودة، يفرض التحوّل الرقمي للقرار الإداري ضرورة توفير إحاطة تشريعية كافية وكفيلة باستيعاب مفرزات هذا التحوّل، بحيث تشكّل أساسا قانونيا لانتقال آمن نحو الرقمنة. The digital transformation of modern management activities is an inevitable trend, imposed by the need to keep pace with the speed of technological and technical progress. This transformation has led to the emergence of new forms of administrative legal actions, among them the electronic administrative decision, as a digital version of the traditional administrative decision in the digital environment. Despite the advantages of the digital approach in the field of administrative decisions, it raises complex legal challenges from a theoretical standpoint, related to the ambiguity of the concept of the electronic administrative decision and the difficulty of defining it precisely. It also presents multiple practical legal issues concerning the challenges of implementing it in reality, given the incompatibility of subjecting it to the traditional legal framework. In light of this situation, and to ensure the desired digital effectiveness, the digital transformation of administrative decisions necessitates providing sufficient legislative coverage capable of accommodating the developments and outcomes of this transformation. This legal framework would form the foundation for a safe transition toward digitization.
